Contest Rules and Regulations:

Participation in the Contest constitutes full and unconditional agreement and acceptance of these Contest Rules and Regulations ("Contest Rules"), which are final on all matters relating to the Contest.

1. Contest Period:
   
   The CrossBorderShopping.ca Mall of America Cross Border Shopping Spree Contest (the "Contest") begins at 12:05:01 p.m. ET on Tuesday, May 5, 2015 and closes at 11:54:59 a.m. ET on Friday, June 5, 2015 (the "Contest Period").
   
   The Contest is sponsored by CrossBorderShopping.ca (the “Contest Sponsors”). The Prizes have been contributed by Mall of America (the “Prize Contributors”). The Contest is administered by CrossBorderShopping.ca and CrossBorderShopping.ca’s computer is the official clock of the Contest. Any entries received after the end of the Contest Period will be void.
    
2. Eligibility: 
   
   This Contest is open to all legal Manitoba and Ontario residents who have reached the age of majority at the time of entry. The Contest Sponsors reserve the right to require proof of age prior to awarding any Prize. This Contest is not open to: (i) employees (and their immediate families and those with whom they are domiciled) of the Contest Sponsors and the Prize Contributors; (ii) subsidiaries, affiliates, directors, officers, governors, agents and representatives of the Contest Sponsors and the Prize Contributors; or (iii) any advertising and promotional agencies assisting with the promotion of this Contest. For the purposes of these Contest Rules, "immediate family" includes the spouse, son, daughter, brother, sister, mother or father of an individual (whether step-, half- or adopted).
    
3. How to Enter: 
   
   No purchase necessary. To enter the Contest, visit www.crossbordershopping.ca/contests, follow the Contest link and fully complete and submit the online entry form.
   
   Entrants may submit a maximum of one (1) entry during the Contest Period.
   
   Entries must be submitted from a valid e-mail account that may be identified by reverse domain name search. Multiple entries by the same individual using multiple e-mail accounts or using any device to play multiple times or as multiple entrants are strictly prohibited. All entries are subject to verification by the Contest Sponsors. If the Contest Sponsors discover that an entrant has attempted to enter the Contest other than in accordance with this Rule 3, that entrant will be disqualified from the Contest.
   
   Potential Prize winners may be required to provide the Contest Sponsors with proof that the potential Prize winner is the authorized account holder of the e-mail address associated with the winning entry. All entries will become the exclusive property of the Contest Sponsors and will not be acknowledged or returned. Entries which are incomplete or fraudulent are null and void. The Contest Sponsors accept no responsibility for entries which are lost, misdirected or delayed for any reason. Nor is any responsibility assumed for incomplete entries, incorrect or inaccurate capture of entry information, including (but not limited to), malfunction (including, without limitation, technical malfunctions of any telephone network or lines, computer online systems, servers or services), human error, lost/delayed/garbled internet/e-mail transmission, omission, interruption, deletion, defect, or failures of any telephone, technical, network, online, hardware or software or any combination hereof and assume no liability for damage to entrant’s or any person’s computer resulting from participating in the Contest or the failure of Contest Sponsors to process any entry and otherwise award any Prize.
    
4. Prizes: 
   
   There is a total of one (1) prize available to be won (the “Prize(s)”). The prize consists of:

   • $250 Mall of America VISA® Gift Card

   • Three night hotel stay at the Radisson® Hotel Bloomington + 4 Water Park passes

   • 2015 Mall of America Coupon Book

   • Dinner for 4 at the Hard Rock Cafe

   • 4 Nickelodeon Universe® All-Day Unlimited Ride Wristbands

   • 4 SEA LIFE® Minnesota Aquarium passes

   • 4 Moose Mountain Adventure Golf passes

   • 4 Dutchman's Deck Adventure Course passes

   Approximate total retail value of the Prize is $1,000 CDN.
   
   The odds of winning a Prize depend on the total number of eligible entries received during the Contest Period.
   
   All incidental costs and expenses associated with the Prize that are not specifically referred to in these Contest Rules, including (without limitation) taxes, duties, travel, accommodations, transportation, entertainment, food, beverages, travel and medical insurance and expenses, gratuities, incidental and personal expenses, and items of a personal nature, are not included and are the sole responsibility of the Prize winner.
   
   The Prize does not include transportation or travel, which shall be the sole responsibility of the Prize winner.

   All hotel accommodations must be arranged by the Prize winner directly with the hotel using the hotel vouchers provided with the prize package, and will be subject to any terms and restrictions of the hotel. Hotel dates available to the Prize winner are subject to availability.  Once the hotel accommodations have been finalized between the Prize winner and the hotel, no changes can be made unless approved by the hotel in its sole discretion.

   The Prize winner may be required to present a valid major credit card in his/her name upon hotel check-in to cover any additional expenses incurred above and beyond the standard room charges. The Contest Sponsors and Prize Contributors shall not be responsible for any additional expenses incurred by the Prize winner above and beyond the standard room charge, and all such additional expenses shall be the sole responsibility of the Prize winner.
   
   The Prize winner and/or their travel companions are responsible for all required travel documentation including a valid passport and must be free from any legal restrictions on their ability to travel or otherwise participate in the Prize that has been awarded. The Contest Sponsors are not responsible for any costs, expenses or inconveniences if the Prize winner and/or their travel companions are denied entry into the United States.

5. Draw: 
   
   One (1) random draw (a "Draw") will be conducted by CrossBorderShopping.ca from among all eligible entries received during the Contest Period to determine the potential Prize winner(s). The potential Prize winner(s) will be notified by either telephone or e-mail at the telephone number/e-mail address provided on the Contest entry form within forty eight (48) hours following selection. In the event that the Contest Sponsors are unable to contact a potential Prize winner(s) within such 48-hour period following selection, the Contest Sponsors reserve the right to disqualify the applicable potential Prize winner and select a new potential Prize winner. 
   
   The Prize Draw Date will be as follows: One (1) potential Prize winner will be selected on or around Monday, June 8, 2015 (the “Draw Date”). The potential Prize winner(s) will be selected from the total number of eligible entries received during the Contest Period.
   
   Before being declared a Prize winner, potential Prize winners must: (i) correctly answer a time-limited mathematical skill-testing question without human, electronic, mechanical or other assistance; (ii) provide the Contest Sponsors with a signed Declaration of Compliance with the Contest Rules ("Declaration of Compliance"), and (iii) provide the Contest Sponsor with a Release of Liability signed by the potential Prize winner and, if applicable, his/her travel companion, releasing and indemnifying the Contest Sponsors and the Prize Contributors and each of their respective subsidiaries, affiliates, directors, officers, governors, agents and representatives (collectively, the "Released Parties") from any and all liability in connection with: (a) the Prize winner(s) participation in the Contest; (b) the acceptance and use of any Prize awarded in the Contest; and (c) the administration of the Contest by the Contest Sponsors, including (without limitation) the selection of the Prize winner(s) or the distribution of the Prizes awarded in this Contest.
   
   The Declaration of Compliance and Release of Liability must be returned on or before the date indicated on such documents or the Prize(s) will be forfeited. The Contest Sponsors reserve the right to require any travel companion of the Prize winner to provide the Contest Sponsors with a signed Release of Liability prior to their participation in the Prize. Further, the Contest Sponsors may require the Prize winners and their travel companions to sign any additional documents prior to their participation in the Prize, including but not limited to additional releases and/or consents.
   
   If a potential Prize winner cannot answer, or incorrectly answers, the mathematical skill-testing question, or, in the case that a potential Prize winner fails to respond to the notification by 5:00 p.m. ET two (2) business days following the date on which they are notified , or if a potential Prize winner otherwise does not satisfy the Contest eligibility requirements, or satisfy any other Contest conditions, or voluntarily withdraws from participation in the Contest, that potential Prize winner will be disqualified and another potential Prize winner may be selected. Should another new potential Prize winner not be selected, the applicable Prize will be forfeited and no such Prize will be awarded.
    
6. General Rules:
   
   Each Prize must be accepted as awarded and no Prize substitutions of cash or otherwise or transfer of the Prize will be made, provided that the Contest Sponsors may make Prize substitutions of equal or greater value for any reason without prior notice. Refunds, resale and transfers of Prizes are not permitted. Only potential Prize winners will be notified.
   
   Potential Prize winners will each be required to consent to the use of his/her name, image, photograph, voice statement(s), and city of residence by the Contest Sponsors, without further compensation or future notice, for any and all publicity purposes, commercial or otherwise, in all media, prior to being awarded the Prize. The Contest Sponsors may require the travel companions of the Prize winners to consent to same prior to their participation in the Prize.
   
   Entrants hereby release, waive and discharge any and all claims of damage, loss or causes of action (including, negligence), including (but not limited to) death, personal injury or loss or damage to property, which the entrant or any of the entrant’s representatives, heirs, next of kin or assignees ("Entrant’s Representatives") may have or which may hereinafter accrue to the entrant or Entrant Representatives against the Released Parties as a result of: (i) the entrant’s participation in the Contest, (ii) the receipt or use of the Prize(s) awarded in connection with this Contest; and (iii) the administration of the Contest (including winner selection) and distribution of the Prizes awarded herein.
   
   By entering the Contest, entrants agree to hold harmless and indemnify the Released Parties against any and all liability, damages or causes of action (however named or described with respect to or arising out of either: (i) entrant’s participation in the Contest; (ii) the receipt or use of the Prizes awarded herein; or (iii) the administration of the Contest (including winner selection) and distribution of the Prizes awarded herein.
   
   The Contest is subject to all applicable federal, provincial and municipal laws and regulations and will be governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. These Contest Rules are subject to change without notice in order to comply with any applicable federal, provincial and municipal laws or the policy of any other entity having jurisdiction over the Contest Sponsors. All issues and questions concerning the construction, validity, interpretation and enforceability of the Contest Rules or the rights and obligations as between any entrant and the Contest Sponsors in connection with the Contest will be governed by and construed in accordance with the laws of the Province of Ontario including procedural provisions without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other jurisdiction’s laws.
   
   By entering the Contest, each entrant agrees to be bound by these Contest Rules and all decisions of the Contest Sponsors, which decisions are final with respect to all matters relating to the Contest, including (without limitation) the selection of the Prize winners.
   
   The following are prohibited and will result in automatic disqualification from the Contest: (1) using any method that artificially increases odds of winning; (2) non-compliance with these Contest Rules; and (3) any other act which the Contest Sponsors determine, at their sole discretion, jeopardizes the integrity of the Contest.
   
   The Contest Sponsors may terminate, modify, suspend or withdraw from this Contest (and/or any aspect thereof, including methods for selection of the Prize winners), in whole or in part, at any time without notice for any reason, without liability, at their sole discretion.
   
   In the event of any discrepancy or inconsistency between the terms and conditions of the Contest Rules and disclosures or other statements contained in any Contest-related materials, including but not limited to the Contest entry form, these Contest Rules will prevail, govern and control.
   
   In addition, the Contest Sponsors will not assume any responsibility of any nature whatsoever in all cases where their inability to hold the Contest or to remit the prizes to the winners results from a cause beyond their control, including acts of God, weather conditions, strike, lock-out or other labour dispute.
   
   Any attempt to deliberately damage any website or to undermine the legitimate operation of this Contest is a violation of criminal and civil laws, and should an attempt be made, the Contest Sponsors reserve the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution
   
   All intellectual property, including but not limited to trade-marks, trade names, logos, designs, promotional materials, web pages, source code, drawings, illustrations, slogans and representations are owned by the Contest Sponsors, Prize Contributors and/or their affiliates.
   
   By completing and submitting the information requested for participation in the Contest, an entrant consents to the collection, use, and disclosure of his/her personal information by the Contest Sponsors and their agents and representatives for the purposes of (i) their internal use to facilitate the administration of the Contest, and (ii) if an entrant has so elected, to allow the Contest Sponsors and/or authorized third parties selected by the Contest Sponsors to provide the entrant with information on the Contest Sponsors’ products and/or services. The collection, use and/or disclosure of any personal information an entrant provides are subject to CrossBorderShopping.ca’s Privacy Policy, which is set out at http://www.crossbordershopping.ca/privacy-policy.
   
   A complete list of Prize winners can be obtained by sending a self-addressed, postage pre-paid envelope to: CrossBorderShopping.ca, 188 Cleveland Street, Toronto, Ontario, M4S 2W6. Requests must be received no later than 30 days after the Draw date. Any requests received after this date will not be processed.​
